Agreement to Terms

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and MapOfOntario.com ("we," "us," or "our"), concerning your access to and use of the mapofontario.com website (the "Site") as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the "Site").

You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these Terms of Use. If you do not agree with all of these Terms of Use, then you are expressly prohibited from using the Site and you must discontinue use immediately.

We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use at any time and for any reason. We will alert you about any changes by updating the "Last Updated" date of these Terms of Use, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Terms of Use to stay informed of updates. You will be subject to and will be deemed to have been made aware of and to have accepted the changes in any revised Terms of Use by your continued use of the Site after the date such revised Terms of Use are posted.

Permitted Uses

MapOfOntario.com provides free access to Ontario maps for personal, educational, and limited non-commercial purposes. The following uses are permitted without requiring additional permission:

Personal Use

You may freely view, download, print, and use our maps for personal purposes. Personal use includes travel planning, navigation reference, home projects, personal research, and general information. You may print maps for your own use, share printed maps with family and friends, and use maps to plan trips or activities.

Educational Use

Educators, students, and educational institutions may use our maps for educational purposes without charge. Educational use includes classroom instruction, homework assignments, school projects, presentations, research papers, theses, and dissertations. Teachers may print and distribute maps to students, include maps in lesson materials, and project maps during classroom instruction. Students may use maps in reports, projects, and presentations for academic credit.

Educational use must be non-commercial in nature. Educational institutions may not charge students specifically for access to MapOfOntario.com materials, though general tuition and fees for educational programs are not considered charging for maps.

Non-Profit and Community Use

Non-profit organizations, community groups, libraries, and similar entities may use our maps for non-commercial community purposes such as community planning, public information campaigns, volunteer coordination, and educational outreach. This use is permitted provided there is no commercial benefit derived from the use of the maps.

Restrictions on Use

While we provide free access for permitted uses, certain uses are restricted and require permission:

Commercial Use Restrictions

Commercial use of maps from MapOfOntario.com is prohibited without express written permission. Commercial use includes but is not limited to: selling or licensing maps or map-derived products; incorporating maps into commercial products or services; using maps in advertising or marketing materials; including maps in publications sold for profit; using maps as part of paid consulting, research, or advisory services; or displaying maps on commercial websites where the primary purpose is generating revenue.

If you wish to use our maps for commercial purposes, you must contact us at [email protected] to request permission and discuss licensing arrangements. Commercial licensing is handled on a case-by-case basis and may involve licensing fees.

Attribution Requirements

When you use, display, or distribute maps from MapOfOntario.com, you must provide appropriate attribution. For printed materials, digital publications, presentations, or public displays, include credit in the form: "Map courtesy of MapOfOntario.com" or "Source: MapOfOntario.com" near the map or in an appropriate credits section.

For personal use where attribution is impractical (such as printing a map for your own navigation), attribution is appreciated but not required.

Modification Restrictions

You may not modify, alter, edit, or create derivative works based on our maps without permission. This includes but is not limited to: removing or altering copyright notices or attributions; adding or removing map features or labels; changing colors, styling, or design elements; combining our maps with other data or maps in a way that creates a new map product; or extracting data from our maps for use in creating new maps.

If you need modified or customized maps for legitimate educational or non-commercial purposes, please contact us to discuss your needs.

Redistribution Restrictions

You may not systematically download, collect, or redistribute our maps in bulk. Specifically, you may not: create a competing map website or service using our maps; offer our maps for download on other websites without permission; incorporate our maps into software applications or databases for distribution; or scrape, mirror, or systematically copy the Site's content.

Sharing individual maps with specific people for permitted uses (such as a teacher sharing a map with students, or sharing a map with a travel companion) is allowed. Mass distribution or systematic redistribution is not permitted without permission.

Intellectual Property Rights

Unless otherwise indicated, the Site and all content, features, and functionality on the Site (including but not limited to maps, text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software) are owned by MapOfOntario.com or our licensors and are protected by Canadian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms of Use permit you to use the Site and maps for permitted uses as specified above. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site except as expressly permitted under these Terms of Use.

The MapOfOntario.com name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of MapOfOntario.com or its affiliates or licensors. You must not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on this Site are the trademarks of their respective owners.

Accuracy and Completeness

We strive to provide accurate, up-to-date maps based on reliable geographic data. However, maps are representations of geographic information and may contain errors, omissions, or out-of-date information. MapOfOntario.com makes no warranties, express or implied, regarding the accuracy, completeness, reliability, or suitability of any maps or information on the Site.

Geographic features, boundaries, roads, and other information change over time. While we regularly update our maps, there may be lag between real-world changes and updates to our maps. You are responsible for verifying critical information through official sources when accuracy is essential for your purposes.

Maps are provided for general reference and educational purposes. They should not be used as the sole source for critical navigation, property boundaries, legal determinations, emergency services, or other situations where inaccurate information could result in harm or loss.

Disclaimer of Warranties

THE SITE AND ALL MAPS, CONTENT, AND SERVICES PROVIDED ON OR THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER MAPOFONTARIO.COM NOR ANY PERSON ASSOCIATED WITH MAPOFONTARIO.COM MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SITE.

WITHOUT LIMITING THE FOREGOING, NEITHER MAPOFONTARIO.COM NOR ANYONE ASSOCIATED WITH MAPOFONTARIO.COM REPRESENTS OR WARRANTS THAT THE SITE, ITS CONTENT, OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITE WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT THE SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE SITE OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITE WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.

MAPOFONTARIO.COM HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE.

Limitation of Liability

IN NO EVENT WILL MAPOFONTARIO.COM, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SITE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SITE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

The limitation of liability set out above does not apply to liability resulting from our gross negligence or willful misconduct, or where prohibited by applicable law.

Indemnification

You agree to defend, indemnify, and hold harmless MapOfOntario.com, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Use or your use of the Site, including but not limited to your use of maps in violation of permitted uses, any use of the Site's content, services, and products other than as expressly authorized in these Terms of Use, or your use of any information obtained from the Site.

Governing Law and Jurisdiction

These Terms of Use and your use of the Site are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law provisions.

Any legal action or proceeding arising under these Terms of Use will be brought exclusively in the federal or provincial courts located in Ontario, Canada, and you irrevocably consent to personal jurisdiction and venue in such courts.

User Conduct

By using the Site, you agree that you will not:

  • Use the Site in any way that violates any applicable federal, provincial, local, or international law or regulation
  • Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site, or which may harm MapOfOntario.com or users of the Site
  • Use any robot, spider, or other automatic device, process, or means to access the Site for any purpose, including monitoring or copying any material on the Site
  • Use any manual process to monitor or copy any material on the Site or for any unauthorized purpose without our prior written consent
  • Introduce any viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful
  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Site, the server on which the Site is stored, or any server, computer, or database connected to the Site
  • Attack the Site via a denial-of-service attack or a distributed denial-of-service attack
  • Otherwise attempt to interfere with the proper working of the Site

Termination

We may terminate or suspend your access to the Site immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms of Use. Upon termination, your right to use the Site will immediately cease.

All provisions of these Terms of Use which by their nature should survive termination shall survive termination, including without limitation ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Severability

If any provision of these Terms of Use is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver

No waiver by MapOfOntario.com of any term or condition set out in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of MapOfOntario.com to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.

Entire Agreement

These Terms of Use, together with our Privacy Policy, constitute the sole and entire agreement between you and MapOfOntario.com regarding the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Site.
